Mutant Auctions ("Mutant Auctions" or "MutantAuctions.com" or "We" or "Website" or "Site") is an online store allowing users to bid in auctions and for the winner of the auction to purchase products at the amount of the lowest unique bid in compliance with the Terms and Conditions described below. A "Member" is a person who is legally eligible to use the Service, who has duly filled in the registration form and has been accepted, automatically or manually, by Mutant Auctions. The Member agrees to be bound by these Terms and Conditions for all actions taken through the Mutant Auctions website, or in reasonable connection with the Mutant Auctions service.

In using this website, you agree that you have read, accept, and agree to abide by the following Terms and Conditions.

1. Eligibility

By accessing this website, the member exercises the right to act autonomously, and guarantees the right, authority and capacity to accept the present Agreement, agrees with all the Terms and Conditions and guarantees that he/she is aged 18 or over, or as legally required in the country of residence. The member agrees that their actions taken on, and in relation to, the site are bound by the laws of the United Kingdom, and that their actions on and in relation to the site will be bound by these laws. The member recognizes having the capacity to understand, and having understood, the principles and functioning of the Site. Only one account may be created per Internet Protocol (IP) address, and only one account is valid per household.

2. Registration and Personal Protection
The member is responsible for maintaining the validity of all information provided to Mutant Auctions through any means of communication, including but not limited to through the registration process, account management functions, and email or phone contact. The member unconditionally accepts without exception not to knowingly provide misleading or untrue information to Mutant Auctions. If a member's details change, the member is responsible for maintaining the validity of all of their details through the methods provided on the Website. The member is entirely responsible for maintaining the confidentiality of their password and account and has sole responsibility for any and all activities that occur under their account. The Account is personal to the Member and may not be transferred or made available, directly or indirectly, to others and no Member can use another Member's Account at any time. All use of the data provided by the Member to the website is bound by our Privacy Policy. The Member can request that all personal data held by the Website be communicated to them through the Website.

3. Service
Our service is limited to the choice of suppliers and products placed on sale. Our Service includes monitoring the regular execution of sales based on a lowest unique bid auction system, and monitoring that the product purchased is delivered to the buyer. In addition, the Mutant Auctions Service includes the management and updating of the Site and of its web and software parts, as well as the management of all the costs related to servers, employees, advertising and costs related to the management of a Company.You hereby agree and accept that the Service offered and for which you decide to buy Credits is reasonable. Members who wish to place bids accept and agree to buy Credits in order to receive these Services.
IF, FOR WHATEVER REASON, YOU DO NOT AGREE WITH THE SERVICE WE OFFER PLEASE DO NOT REGISTER WITH THE SITE AND DO NOT USE THE SERVICES.

4. Use of the Service
The member agrees not to commit fraud, abuse or misuse of the Service, or breach of the Terms and Conditions governing the website. Mutant Auctions reserves the right to suspend an account based on suspicion of having committed or having intention to commit, fraud, misuse of the Service, or breach of the Terms and Conditions governing the website. The suspension of an account allows Mutant Auctions the right to remove any unused credits from an account without refunding the purchase of those credits. Credits can be removed for an active Account if no bid is placed through the Account within a period of six (6) months.

Mutant Auctions reserves the right to terminate the Account of any Member, at any time without a specific reason. The closure or suspension of the Account implies that if bids have been placed for a product and if the right to purchase has been acquired through any form of manipulation (defined at the unquestionable judgment of Mutant Auctions), the Member shall not receive the product and shall be liable for legal action. In case of suspected manipulation of the system once the product has been delivered to the Member, the Member who has received the product shall be obliged and responsible for the return of the product or shall pay Mutant Auctions for the product at the commercial value indicated on the Site within ten (10) days from notification. If the product is not fully returned or paid the matter shall be passed onto a credit collection agency appointed by Mutant Auctions.

No credit or credits, used or unused, will be refunded for any reason.

5. Phrase sub not found!
Access to the Site and registration are free. To receive the Services, described in the "Service" paragraph, offered by Mutant Auctions you must buy Credits, which you agree and accept shall not be refunded for whatever reason, as the Service, within the terms described, supplied by Mutant Auctions concerns Site management and the costs sustained by Mutant Auctions. For your purchase of Credits, or in the case of promotions which may be presented from time to time, Mutant Auctions may, at its own discretion and without any obligation, give you Free Credits. In return for purchasing the Mutant Auctions Services you receive Credits, which you can use at your discretion to receive the Information Service for each bid you place. The amount of Credits deducted from your Credits Account purchased is shown on the site and may vary according to the product. By registering as Member and therefore wanting to receive the Mutant Auctions services, you agree and accept that any payment you make to Mutant Auctions is made exclusively to guarantee the continuity of the Service indicated here and that the Information Service offered by Mutant Auctions for each bid is an additional Service offered by Mutant Auctions for which no payment, but only the use of Credits, is required. The Member is solely responsible for any type of management of his/her Account.

6. Electronic Communications
By accessing and using the Site and/or registering for the use of the Service, you agree to receive electronic communications (e-mails) from Mutant Auctions. Furthermore, you agree and hereby accept that Mutant Auctions can choose to communicate with you using other means, in accordance with the information contained in your registration form. We can choose to communicate with you only via e-mail or by publishing information of the Site. You agree that all agreements, notices, documents and any other communication which We send you electronically (via e-mail) satisfy all legal requirements and that said communications shall be sent in writing. We shall not be liable for e-mails or communications sent in any other way which are not received by the Member.

7. Liability
Your use of the Site and Service is at your sole risk. You acknowledge and agree that your sole and exclusive remedy for any dispute with Mutant Auctions is to stop using the Service, and to request a suspension of your account. The Member remains liable for all actions taken in the Member's account, including without limitation, the placement of bids, payment of credits. The Member remains liable for all losses incurred by the Member or a third party on the Member's Account.
Mutant Auctions reserves the right, at any time, to change or interrupt, temporarily or permanently, a part of the Service with or without notice. You agree and accept that We shall not be liable and shall not be subject to sanctions by you or third parties for any change, suspension or interruption of the Service and you agree and accept that you shall not have the right to receive any refund for unused credits unless the Service is permanently closed and interrupted for a continuous period of 12 consecutive months.The Site and Service, and any other third-party Services and products, are provided on an 'as is' and 'as available' basis for your use, without warranties of any kind, either express or implied, unless such warranties are legally incapable of exclusion. Mutant Auctions provides the Services on a commercially reasonable basis and does not guarantee that you will be able to access or use the Services at times or locations of your choosing, or that Mutant Auctions will have adequate capacity for the Services as a whole or in any specific geographic area.
Mutant Auctions shall not be liable in contract, tort, negligence, or otherwise, for any loss or damage whatsoever arising from or in any way connected with your use of the Site or Service, whether direct or indirect, including, without limitation, damage for loss of business, financial loss, business interruption, loss of business or personal information, or any other pecuniary or consequential loss (even where we have been notified by you of the possibility of such loss or damage).
The member agrees and accepts to indemnify Mutant Auctions, affiliates, legal representatives, agents and other partners and employees against any losses, liability, claim or request including reasonable legal expenses paid by third parties following the abuse of the Service in breach of this agreement, infringement of these Terms and Conditions of use and/or any breach of Member guarantees and declarations mentioned above.

8. Products and Postage
All shipping and postage costs will be covered soley by the customer and are charged at standard rates. Mutant Auctions will reasonably inspect product packaging for damanges before transferring products to shipping or postage services. However, through transferring products to shipping or postage services, Mutant auctions will not be held liable for any damage to products resulting from third parties, or damages resulting from the shipping or postage process. Mutant Auctions will not be liable for any misrepresentation of products.

9. Functionality and Working Principles of the Site
The lowest unique auction system applied by Mutant Auctions allows Members, following the Terms and Conditions laid out herein, and in accordance with the rules given below, whilst acknowledging that Mutant Auctions reserves the right, without warning or limitation, or change the rules.

Mutant Auctions exclusively offers Services described in Section 3 of these Terms and Conditions, is not an auctioneer, and does not maintain any of the responsibility or liability associated with the management of auctions other than those explicitly stated herein. Mutant Auctions allows the lowest unique bidder to purchase products at the amount of their bid.

For example, the following represent bid amounts, bids per bid amount and the status of the bids.

£0.03 – 1 bids – Lowest Unique Bid
£0.04 – 3 bids – Not Unique and too high
